1. GENERAL PROVISIONS AND DATA CONTROLLER

Personal data obtained by ANYA BEAUTY in the Online Store, including data obtained during the registration and ordering process, are subject to full legal protection in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

The controller of personal data is ANYA BEAUTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Wrocław, ul. Lekcyjna 101 (51-169 Wrocław), entered into the Register of Entrepreneurs of the National Court Register under the KRS number 0001022210, NIP number 8952253988, REGON number 52460866400000.

2. PURPOSES AND LEGAL BASIS FOR DATA PROCESSING Your personal data are processed for the following purposes: 

a) Fulfillment of orders and performance of the sales contract (Products, Training or Vouchers), including the management of the User Account – legal basis: Article 6 paragraph 1 letter b of the GDPR (necessity for the performance of the contract). 

b) Fulfillment of legal obligations incumbent on the Controller, in particular in the scope of issuing invoices, bookkeeping and tax reporting – legal basis: Article 6 paragraph 1 letter c of the GDPR (legal obligation). 

c) Fulfillment of the Controller’s legitimate interests, such as archival (evidence) purposes, establishing, pursuing or defending against claims, conducting direct marketing activities towards its own customers and statistical analysis of website traffic – legal basis: Article 6(1)(f) of the GDPR (legitimate interest). 

d) Sending commercial information by electronic means (Newsletter) – legal basis: Article 6, paragraph 1, letter a of the GDPR (voluntary consent of the User).

Providing personal data is voluntary, but it is a necessary condition for placing an order, creating an Account or using services provided electronically.

3. DATA STORAGE PERIOD (RETENTION)

Personal data will be stored for the period necessary to achieve the purposes for which they were collected:

a) Data related to the execution of orders and contracts – for the period necessary to execute the contract, and then until the statute of limitations for civil law claims expires (standard 6 years, and for companies 3 years).

b) Accounting and tax data – for the period required by tax law (5 years from the end of the calendar year in which the tax payment deadline expired).

c) Data processed on the basis of consent (e.g. Newsletter) – until the User withdraws this consent.

d) Data processed on the basis of legitimate interest – until the User raises an effective objection.

4. RECIPIENTS OF PERSONAL DATA

To properly operate the Store and fulfill orders, ANYA BEAUTY entrusts or transfers personal data to external collaborators. Data is transferred only to the extent necessary:

a) PayPro SA (Przelewy24) with its registered office in Poznań (KRS 0000347935) – for the purpose of processing electronic payments (data provided: e-mail, name and surname, address). This entity also acts as a separate controller and fulfills the information obligation in accordance with Article 14 of the GDPR.

b) PayPal (Europe) S.à rl et Cie, SCA – for the purpose of processing electronic payments (data transferred: e-mail, name and surname/company, address, telephone number).

c) InPost Sp. z o. o. with its registered office in Kraków (KRS 0000543759) – for the purpose of providing parcel delivery services and handling cash on delivery payments (data provided: e-mail, name and surname/company name, delivery address, telephone number).

d) BaseLinker Sp. z o. o. – for the purpose of using software to automate and process online orders (data provided: e-mail, name and surname/company, address, telephone number).

e) Authorized employees and associates of the Controller and entities providing IT or accounting services.

The Administrator declares that personal data will not be transferred outside the European Economic Area (EEA) or to international organisations.

5. USER RIGHTS In connection with the processing of personal data, each User has the right to: 

a) Access to your data and receive a copy thereof. 

b) Rectify (correct) your data. 

c) Deletion of data ("right to be forgotten") – including in the event of deletion of the Account in the Store. 

d) Data processing restrictions. 

e) Transferring data to another controller (in the scope of data processed on the basis of a contract or consent). 

f) Objection to data processing (in the case of processing based on legitimate interest, including direct marketing). 

g) Withdraw consent to data processing at any time (if the processing is based on consent), without affecting the lawfulness of processing carried out before its withdrawal.

The User also has the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw), if they believe that their data is being processed unlawfully.

6. DATA PROTECTION OF MINORS

ANYA BEAUTY does not intentionally collect personal data from children or minors. If a minor creates an Account, they may do so only with the consent and using the data of their parent or legal guardian, and the Administrator must be notified immediately.

7. COOKIES AND STATISTICAL DATA

a) The online store uses cookies. These are small text files stored on the Customer's device that provide anonymous statistical data about their activity in order to tailor the Store's operation to their needs.

b) The Customer may change their web browser settings at any time and disable cookies. However, the Administrator informs that disabling cookies may hinder or prevent the proper use of certain Store features.

c) The Store uses Google Analytics, provided by Google Ireland Limited, to collect anonymous website traffic statistics. Detailed privacy policy for this tool is available on Google's official website.

8. EXTERNAL LINKS

If the Store contains links to other websites not administered by ANYA BEAUTY, the Administrator is not responsible for the content of those websites or the level of privacy protection implemented by their owners. It is recommended that you review the privacy policies of external websites before providing them with any data.
