STORE REGULATIONS

§1. GENERAL PROVISIONS

These regulations (hereinafter referred to as the "Regulations") define the rules for using the Store, placing orders electronically, delivering ordered Products, paying for ordered Products, as well as the rights of the Customer and the User arising from the sales contract, in particular the rules for withdrawing from this contract and the rules for submitting and considering complaints.

§2. DEFINITIONS

  1. ANYA BEAUTY – ANYA BEAUTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Wrocław, ul. Lekcyjna 101 (postal code 51-169), KRS number 0001022210, NIP number 8952253988, REGON number 52460866400000, e-mail address: shop@anyabeauty.pl

  2. Shop online shop run by ANYA BEAUTY located at the Internet address http://anyabeauty.pl through which ANYA BEAUTY provides services electronically, including an offer of Products;

  3. Customer – a natural person, legal person or organizational unit without legal personality but with legal capacity, using the Store, for whom services may be provided electronically or with whom a sales contract may be concluded;

  4. User – a registered Customer who uses the store via an Account.

  5. Consumer – a Customer who is an individual entering into a sales contract with ANYA BEAUTY for purposes not directly related to their business or professional activity. By using the Store, the Consumer consents to concluding distance contracts using means of distance communication – the Internet and email.

  6. Account – User account, created during registration in the Store, intended for use by one entity;

  7. Electronic payment – ​​a method of making a payment during which the Customer proceeds directly from the Store to select a bank, log in to it and make an electronic transfer (which includes, in particular, payment via Przelewy 24 and PayPal).

  8. Product – accessories and cosmetics sold through the store, which are sent by post or courier, e-books.

  9. Training – services provided by ANYA BEAUTY within the Store under an agreement concluded with the Client, based on conditional access, defined in the Act of 5 July 2002 on the protection of certain services provided electronically based on or consisting of conditional access (i.e. Journal of Laws of 2015, item 1341), and their purchase by the Client is a condition for obtaining access to certain audiovisual materials (digital content provided by ANYA BEAUTY),

  10. Voucher – a document (including an electronic one) confirming the holder’s entitlement to provide training or purchase a Product or Products.

  11. Safe Product – any Product that, under normal or reasonably foreseeable conditions of use, including the actual time of use, does not pose any risk or only a minimal risk consistent with its use, considered acceptable and corresponding to a high level of protection of consumer health and safety;

  12. Risk – a combination of the probability of a hazard causing damage and the degree of severity of that damage

  13. Serious risk – Risk that, based on the Risk Assessment and taking into account the normal and foreseeable use of the Product, is considered to require rapid intervention by market surveillance authorities, including in cases where the effects of the risk are not immediate;

  14. Incident – ​​an accident or problem related to the safety of the Product.

§4. TECHNICAL REQUIREMENTS

  1. The condition for the proper use of the Store is that the Customer has an IT system that meets the following minimum technical requirements:

    1. Access to the Internet;

    2. An up-to-date browser installed on Windows 8+, MAC OSX 10.12+ operating systems (Mozilla Firefox, Opera, Google Chrome, Microsoft Edge, Apple Safari), with cookies and Java Script enabled;

    3. Having a current, active and properly configured email account.

  1. ANYA BEAUTY is not responsible for any technical limitations on the Customer's part if they result from failure to meet the requirements described in the Terms and Conditions. We make every effort to ensure that the Store operates correctly on the widest possible range of devices and systems.

  2. In the event of technical difficulties on the Client’s side, ANYA BEAUTY may provide support to the extent technically and organizationally possible.

§5. ACCOUNT

  1. The customer may make purchases without registration, but is required to provide their name, surname, mailing address, e-mail address and telephone number in order to complete the order.

  2. Creating an Account enables the Customer to, in particular:

    1. entering, editing or deleting data, including delivery addresses;

    2. placing orders using the entered data;

    3. obtaining a permanent discount for professionals;

    4. pay for the order upon receipt of the product at the ANYA BEAUTY headquarters

  3. The condition for creating an Account is to complete a free registration, i.e. correctly complete the form sent to ANYA BEAUTY and accept the provisions of the Regulations;

  4. The data required for registration is:

    1. Username;

    2. email address.

  5. The Account is created for an indefinite period, however, the User may delete his or her Account in the Store at any time without giving any reason and without incurring any additional fees.

  6. After registering the Account, each login is performed using the data provided in the registration form.

  1. The Account may be deleted by sending a statement in this respect via the contact form after logging in to the Account or by e-mail to shop@anyabeauty.pl.

  1. Account deletion is irreversible and results in the deletion of all Account content. Upon Account deletion, the User loses complete access to the Account and order history.

  2. FORM:

– cancellation of the Account. (The form should be completed and returned electronically or in hard copy only if the User wishes to cancel the Account).

  1. ANYA BEAUTY may delete the Account at any time:

    1. if the User uses the Store in a manner inconsistent with the Regulations;

    2. in cases provided for in generally applicable legal provisions

§6. RULES OF USE OF THE STORE

  1. Customers are obligated to

    1. Use the Store in accordance with the Regulations and with respect for the rights of third parties;

    2. Not taking actions consisting in sending or posting unsolicited commercial information in the Store, or posting any content that violates the provisions of the law (prohibition of posting illegal content)

    3. Not to undertake any IT activities or any other activities aimed at obtaining information not intended for the Client, including data of other Clients,

    4. not to take actions that involve unauthorized modification of the content provided by ANYA BEAUTY within the Store or abuse of the rights granted to the Customer by ANYA BEAUTY or legal provisions in a way that is contrary to the socio-economic purpose of a given right or to the principles of social coexistence.

  2. Customers are obliged to provide true information during registration and when using the Store, as well as to update it.

  3. Customers may not, without the consent of ANYA BEAUTY, copy, change the structure, modify or make available to third parties all or part of the content of the Store, in particular the information contained therein.

  4. Declarations of intent by ANYA BEAUTY and Customers are submitted in particular electronically, via the Internet, in particular to the e-mail address provided in the registration form.

  5. ANYA BEAUTY makes every effort to keep the Store updated for a wide range of devices and operating systems, but does not guarantee its compatibility and updateability with every device and system.

  6. ANYA BEAUTY reserves the right to interrupt the operation and access to the Store for an indefinite period of time due to the need to modernize, repair and maintain the Store.

  7. ANYA BEAUTY may change the functionality and content of the Store, suspend, withdraw, or limit the availability of all or part of the Products offered in the Store. If this would significantly limit the functionality of the Store, ANYA will notify Users who have purchased Products.

  8. The Customer may consent to receiving commercial information from ANYA BEAUTY, including electronically, by selecting the appropriate option (e-mail and text messages) in the registration form, or at a later stage. If such consent is granted, the Customer will receive the Store's newsletter at the email address provided during registration, as well as commercial information at the phone number provided during registration ("Newsletter").

  9. The customer may unsubscribe from the Newsletter service at any time.

  10. The User's violation of any of the obligations indicated in points 1-3 above constitutes a violation of the provisions of the Regulations and may result in the deletion of the Account.

§7. SALE OF PRODUCTS, TRAINING, VOUCHERS. DELIVERY

  1. The conclusion of the sales contract for Products/Trainings/Vouchers takes place upon confirmation of acceptance of the order by ANYA BEAUTY at the Customer’s e-mail address provided during registration.

  2. The Customer who is a Consumer may withdraw from the sales contract under the terms specified in § 10

  3. Before placing an order, the Customer should read the description of the Product/Training/Voucher provided in the Store.

  4. All Products offered in the store meet the requirements of Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety, amending Regulation (EU) No 1025/2012 of the European Parliament and of the Council and Directive (EU) 2020/1828 of the European Parliament and of the Council and repealing Directive 2001/95/EC of the European Parliament and of the Council and Council Directive 87/357/EEC (OJ EU L 135 of 2023, p. 1), hereinafter referred to as "GPSR", concerning general product safety.

  5. ANYA BEAUTY ensures that the Products comply with applicable safety standards and have the required markings.

§8. PRICE LIST AND PAYMENT METHODS. PROMOTIONS

  1. The current offer of the Store, together with the price list and delivery costs of the Products, is posted in the Store.

  2. ANYA BEAUTY undertakes to display the price, unit price or information about the reduced price of the product in a clear, unambiguous manner, enabling price comparison, in a place that is publicly available and clearly visible to Customers, in particular Customers who are consumers.

  3. Orders placed in the Store can be paid:

    1. before receiving the product

    2. upon receipt of the product – this option is available only to Users and the collection will take place at the ANYA BEAUTY headquarters.

  4. ANYA BEAUTY does not provide the option of paying for part of the order before receiving the product and for part upon receipt of the product.

  5. Payments for Products can be made via:

    1. traditional bank transfers (payment in advance);

    2. one of the electronic payment systems accepted by ANYA BEAUTY (i.e. Przelewy 24, PayPal), including card payments

    3. at the ANYA BEAUTY headquarters in cash or card upon personal collection of the product;

    4. cash on delivery – payment is made via InPost Spółka z ograniczoną odpowiedzialnością with its registered office in Kraków, KRS number 0000543759

  6. Orders are processed upon receipt of payment transferred to ANYA BEAUTY's bank account or upon confirmation of electronic payment through an ANYA BEAUTY-accepted electronic payment system. If the User selects the payment upon collection at ANYA BEAUTY's office, the product will be packaged and awaiting the customer at ANYA BEAUTY's office immediately after placing the order. If the "cash on delivery" payment option is selected, the order will be processed immediately after placing the order.

  7. ANYA BEAUTY is not responsible for any problems related to payment processing on the part of third parties, e.g. banks or intermediary companies.

  8. The Training order is processed immediately after receipt of payment.

  9. In the case of pre-sale of the Training, access to the Training will be provided from the date indicated in the promotional offer available on the STORE website.

  10. A customer wishing to receive an invoice is required to enter data in the order form.

  11. Invoices are sent in traditional or electronic form. To receive an electronic invoice, the customer must consent to this on the order form.

  12. Electronic invoices are sent in PDF (Portable Document Format) format to the email address provided in the order form. ANYA BEAUTY sends electronic invoices, guaranteeing the authenticity of their origin and the integrity of their content in accordance with applicable law.

  13. The date of payment is considered the date the funds are credited to ANYA BEAUTY's account. ANYA BEAUTY reserves the right to temporarily introduce promotional prices, which are announced on the Store's website. Prices in the price list and the price summary for a given order will reflect these promotions.

  14. In each case of informing about a reduction in the price of a product (goods or services), ANYA BEAUTY undertakes to display information about the lowest price of this product that was valid in the period of 30 days before the price reduction was introduced.

  15. If a given product is offered for sale for a period of less than 30 days, ANYA BEAUTY will, next to the information about the reduced price, display information about the lowest price of that product, which was valid in the period from the date of commencement of offering the product for sale until the date of introduction of the discount.

  16. In the case of goods that spoil quickly or have a short shelf life, ANYA BEAUTY will display information about the price before the discount was first applied, next to the information about the reduced price.

  17. ANYA BEAUTY may provide different reference prices when informing about a product price reduction, provided that they are clearly explained, are not misleading and do not distract the Consumer from the previous price.

  18. In the event that ANYA BEAUTY individually adjusts the price of the product for the Consumer, the Consumer will be clearly and duly informed thereof.

  19. The payment card operator is PayPro SA Settlement Agent, ul. Pastelowa 8, 60-198 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court of Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the KRS number 0000347935, Tax Identification Number (NIP) 7792369887, Regon 301345068.

§9. PLACEMENT AND EXECUTION OF ORDERS.

  1. The order is placed after selecting the Product and correctly completing the order form.

  2. The Customer may place orders for Products/Trainings/Vouchers available in the Store's assortment 7 days a week and 24 hours a day, subject to trade prohibitions or restrictions resulting from the provisions of generally applicable law.

  3. After placing an order and selecting a payment method, the Customer will receive a confirmation of the sales agreement via email, along with instructions on how to proceed and the terms of the agreement. If electronic payment is selected, the Customer will be redirected to the website of the operator acting as an intermediary in the transaction.

  4. Once the payment is credited to ANYA BEAUTY's bank account, the order will be immediately forwarded for execution, provided that the User provides the details of the recipient of the shipment (including the delivery address and contact telephone number).

  5. The customer is obligated to provide a current and accurate address to which the product is to be delivered. If the customer provides an incorrect or inaccurate address, ANYA BEAUTY is not responsible for non-delivery or delay in delivery of the product.

  6. Information about the current order status and estimated delivery date is available after logging in to your Account in the Your Orders section.

  7. If payment is not received within 14 days of placing the order, ANYA BEAUTY has the right to cancel the order.

  8. Delivery of Products/Trainings/Vouchers is available in the territory of the Republic of Poland and European Union countries.

  9. Delivery of Products/Vouchers is subject to payment.

  10. Delivery costs and times depend on the destination country, the selected shipping method, and the logistics provider. Information about available options, estimated delivery times, and costs is presented in the order form before finalizing the order.

  11. The standard delivery time within the Republic of Poland is 1-4 business days, unless otherwise stated in the Product/Voucher description.

  12. Delivery times within the European Union are typically 3 to 10 business days, unless otherwise stated in the Product/Voucher description.

  13. Foreign deliveries are made through logistics operators cooperating with ANYA BEAUTY

  14. If delivery to the selected country is not possible, the Customer will be informed about this before placing the order.

  15. The User may cancel an order by calling +48 691 510 641 or by emailing shop@anyabeauty.pl. Only orders that have not yet been completed can be canceled. In the case of Products, the time of shipment to the Customer is decisive.

§10. WITHDRAWAL FROM THE CONTRACT

  1. The Consumer may withdraw from the Product/Voucher sales contract without giving any reason and without incurring any additional fees within 14 days from the date of delivery of the Products/Voucher to the address indicated by the User.

  2. The Consumer may withdraw from the Training Agreement without providing a reason and without incurring any additional fees until the Store begins providing the ordered service or digital content to the Consumer, within 14 days of concluding the agreement. The Consumer loses the right to withdraw from the Training Agreement if the provision of the service began with their express consent before the withdrawal period expires and after the Store has informed the Consumer of the loss of the right to withdraw from the agreement. The Store begins providing the service upon first logging in.

  3. Withdrawal from the Product sales contract takes place by means of an unequivocal declaration by the Consumer

  4. A template for the declaration of withdrawal from the Product/Voucher sales agreement is provided as Appendix 1 to these Terms and Conditions. Consumers may use the template form, but it is not mandatory.

  5. If the Consumer submits a declaration of withdrawal from the contract via e-mail, the declaration should be sent to shop@anyabeauty.pl. If the Consumer submits a declaration of withdrawal in writing, the declaration should be sent to ANYA BEAUTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Lekcyjna nr 101, 51-169 Wrocław.

  6. In order to meet the deadline for withdrawal from the contract for the sale of Products/Voucher, it is sufficient for the Consumer to send information concerning the exercise of his right to withdraw from the contract before the expiry of the deadline for withdrawal from the contract.

  7. In the event of withdrawal from the Product/Voucher sales agreement, the Customer will be refunded all payments received, including the costs of delivery. If the Consumer selects a delivery method other than the cheapest delivery method offered by ANYA BEAUTY, only the costs of returning the Products will be refunded, up to the amount corresponding to the cheapest delivery option. The refund will be made immediately, and in any case no later than 14 days from the date on which ANYA BEAUTY was informed of the decision to exercise the right of withdrawal, subject to point 9 below. The form of refund depends on the payment method chosen when placing the order.

  8. In the event of withdrawal from the Training Agreement, the Consumer will be refunded all payments received. The refund will be made immediately, and in any event no later than 14 days from the date on which the Store is informed of the decision to exercise the right of withdrawal.

  9. ANYA BEAUTY reserves the right to withhold reimbursement of payments for the Products until the Products have been received back or the Consumer has provided proof of having sent them back, whichever occurs first.

  10. The Consumer is obligated to return the Products to ANYA BEAUTY in undamaged condition immediately, but no later than 14 days from the date on which they withdrew from the Product sales contract. To meet the 14-day deadline, it is sufficient to return the Products before its expiry.

  11. Returned Products should be packed and secured in such a way that they will not be damaged during transport.

  12. The Consumer bears only the direct costs of returning the Products, i.e. the cost of sending the Products back to ANYA BEAUTY.

  13. The Consumer is liable for any diminished value of the returned Products resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the Products. ANYA BEAUTY reserves the right to pursue claims against the Consumer, including for damages, to the extent permitted by applicable law.

§ 11. ANYA BEAUTY LIABILITY. COMPLAINTS

  1. ANYA BEAUTY is committed to delivering defect-free products and is liable to the Customer if the purchased Products have a physical or legal defect (warranty). Products offered by the Store comply with the contract within the meaning of EU consumer law.

  2. If the purchased Products have defects, the Customer may:

    1. request the replacement of the Products with new ones;

    2. demand removal of the defect,

    3. submit a declaration of price reduction,

    4. submit a declaration of withdrawal from the contract, provided that the defect is significant.

  3. The Customer is not entitled to submit a price reduction or withdrawal from the contract if ANYA BEAUTY promptly and without undue inconvenience replaces the Products with defect-free ones or removes the defect. This limitation does not apply if the Products have already been repaired or ANYA BEAUTY has failed to fulfill its obligation to replace or remove the defect.

  4. If the Customer is a Consumer, they may request a replacement of the Product with a defect-free product instead of the defect removal proposed by ANYA BEAUTY, or request the removal of the defect instead of replacement. This right does not apply if restoring the Product to conformity with the contract in the manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by ANYA BEAUTY.

  5. If the Consumer, in exercising his/her rights under the warranty for physical or legal defects of the Product, requests its replacement or repair, or withdraws from the contract, the delivery of the Product subject to the complaint to ANYA BEAUTY shall be carried out by the Consumer, but at the expense of ANYA BEAUTY, with the proviso that only the costs of returning the Product subject to the complaint shall be reimbursed up to the amount corresponding to the cheapest delivery option.

  6. The costs of returning the Product complained about by a Customer who is not a Consumer shall be borne by the Customer.

  7. Complained Products should be returned to the following address: ANYA BEAUTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Wrocław, ul. Lekcyjna 101 (postal code 51-169). For identification purposes, the Product in question should be accompanied by the order number, a description of the reason for the complaint, and an indication of the scope of actions the Customer expects ANYA BEAUTY to perform. A sample Product complaint form is attached as Appendix 2 to these Terms and Conditions.

  8. It is recommended to attach proof of purchase or a copy thereof to the Product being complained about, as this will facilitate complaint processing. However, failure to attach proof of purchase or a copy thereof will not prevent the complaint process.

  9. ANYA BEAUTY undertakes to consider the complaint within 14 days of its receipt.

  10. If the Customer’s complaint is accepted, ANYA BEAUTY bears the cost of returning the Product subject to the complaint (receipt of the complaint) and sending the Product free from defects (if this method of settling the complaint was chosen).

  11. If the complaint is rejected, the Product will be returned at the Customer's expense.

  12. In the event of withdrawal from the sales contract for Products due to defects, ANYA BEAUTY shall refund to the Customer the previously paid delivery costs in full or in part.

  13. A partial refund of delivery costs is available if the Products in question were one of several in an order placed by the Customer. In such cases, the refund of delivery costs is made proportionally to the value of the order.

  14. In the cases referred to in points 10 and 12 above, ANYA BEAUTY covers the costs only up to the amount corresponding to the cheapest delivery option offered in the Store.

  15. The refund of delivery costs to the User's bank account will be made immediately.

  16. The Store undertakes to provide Training with due diligence in accordance with the principles set out in the Regulations.

  17. Any reports regarding the possible improper implementation of the Training should be sent to the email address shop@anyabeauty.pl. The Store undertakes to respond within 14 business days of receiving the report and informing the Customer.

  18. The Store is not responsible for the effect expected by the User and the purpose of using the Training, including the effectiveness of learning via the Store.

  19. Consumers also have the option of using the online dispute resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr. This platform enables out-of-court resolution of disputes related to online purchases.

§12. PERSONAL DATA

  1. Personal data obtained by ANYA BEAUTY in the Store, including data obtained during the registration process in the Store, are protected.

  2. Deletion of personal data. Any request by the User to have ANYA BEAUTY delete the personal data provided in the registration form will result in the data being deleted.

  4. Contact with the Administrator is possible:

  5. Personal data are processed:

    1. for direct marketing purposes;

    2. for analytical and statistical purposes;

    3. resulting from the legitimate interest of the Controller, i.e. for archival (evidence) purposes, securing information in the event of a legal need to prove facts or demonstrate performed obligations, in order to establish, pursue or defend against claims, and to conduct the Controller's operational activities;

    4. in order to process payments – in the case of electronic payments, ANYA BEAUTY has the right to transfer the customer’s personal data, including e-mail address, name and surname (company name), and residential address – about which the customer will be informed in accordance with Article 13 paragraph 1 letter e) of the GDPR.

    5. ANYA BEAUTY declares that it has entered into an Agreement on accepting payments using payment instruments with PAY PRO SA, KRS number 0000347935, and therefore, when making payments using payment services provided by the aforementioned company, ANYA BEAUTY transfers the Customer's personal data to PAY PRO. SA, including their email address, first and last name, and address of residence. Furthermore, PAY PRO SA, as the controller of this data, will inform the customer within the timeframe and in the manner specified in Article 14, paragraph 3 of the GDPR, that it has obtained this personal data from ANYA BEAUTY;

    6. ANYA BEAUTY declares that it has entered into an Agreement with PayPal (Europe) S.à rl et Cie, SCA ("PayPal"); and uses PayPal, in particular, to receive payments from sales. Therefore, when making payments using PayPal's payment services, ANYA BEAUTY transfers the Customer's personal data to PayPal, including email address, first and last name/company name, home address/company headquarters, and telephone number.

    7. ANYA BEAUTY declares that it has entered into a Subscription Agreement with Inpost, KRS number: 0000543759, regarding postal and transport services and related services (including cash on delivery). Therefore, when processing shipments and payments through Inpost, ANYA BEAUTY provides Inpost with the Customer's personal data, including email address, first and last name/company name, residential address/company headquarters, and telephone number.

    8. ANYA BEAUTY declares that it uses the services of BaseLinker sp. z o.o., which provide access and licenses to software designed to support ANYA BEAUTY's online sales through the BaseLinker.com website. Therefore, when shipping and payments are made through the website, ANYA BEAUTY provides BaseLinker sp. z o.o. with the Customer's personal data, including email address, first and last name/company name, home address/company headquarters, and telephone number.

  1. Providing data is voluntary, but necessary to achieve the above purposes.

  2. Personal data retention period. Personal data processed are retained for the period necessary to fulfill the purpose for which the data is processed (including in accordance with applicable legal requirements).

  3. Legal basis for personal data processing. Personal data is processed when:

    1. Processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject before entering into a contract (Article 6(1)(b) of the GDPR);

    2. Processing is necessary to comply with a legal obligation to which ANYA BEAUTY is subject as the Controller (Article 6, paragraph 1, letter c of the GDPR);

    3. Processing is necessary for the purposes resulting from the legitimate interest of the Controller, i.e. for archival (evidential) purposes, securing information in the event of a legal need to prove facts or demonstrate, demonstrate performed obligations, in order to establish, pursue or defend against claims, conduct the Controller's operational activities and marketing activities.

  4. Data Recipients. The recipients of your personal data are individuals authorized by the Controller to process data as part of their official duties, as well as entities commissioned by the Controller to perform activities that require data processing ("Processors"). Recipients of your personal data may also include entities authorized to access your data only in justified cases and under applicable law. Your data will not be transferred outside the European Economic Area.

  5. Due to the fact that ANYA BEAUTY uses personal data, the User has the right to:

    1. access to personal data;

    2. request the rectification, deletion and restriction of the processing of personal data;

    3. object to data processing due to specific situations – in cases where we use the data based on our legitimate interest;

    4. to transfer personal data, i.e. the right to receive your personal data from us in a structured, commonly used and machine-readable format.

  6. Furthermore, the User may transfer this personal data to another data controller or request that the Controller transfer this data to another controller. However, the Controller will only do so if such transfer is technically feasible. The right to transfer personal data only applies to data processed by us on the basis of a contract.

  7. To exercise the rights indicated in points 10 and 11 above, please contact the Administrator.

  8. Users also have the right to lodge a complaint with the supervisory authority responsible for personal data protection, i.e., the President of the Personal Data Protection Office. We assure you that we make every effort to ensure the physical, technical, and organizational protection of personal data against accidental or intentional destruction, accidental loss, alteration, unauthorized disclosure, use, or access, in accordance with all applicable regulations. If you wish to exercise this right, please contact shop@anyabeauty.pl.

  9. ANYA BEAUTY does not collect personal data from children or minors. If an Account is created by a child or minor, it is only with the consent and using the data of a parent or legal guardian – in which case ANYA BEAUTY must be notified immediately.

  10. The Store also uses cookies. These files are stored on the Customer's computer by the server and provide statistical data about the Customer's activity, in order to tailor the offer to their individual needs and tastes. The Customer may disable cookies in their web browser at any time, although they should be aware that in some cases, disabling these files may impede their use of the Online Store's offerings.

  11. If the Store's website contains links to other websites not administered by the Store, the Store is not responsible for the content of those websites or the level of privacy protection implemented by their administrators. Customers who decide to visit such websites do so at their own risk. The Store also encourages customers to review the privacy policies of those websites before providing them with their personal data.

  12. The Store also collects anonymous statistical data about the pages you visit. This data is used solely for statistical analysis of traffic on the Store's websites. The Google Analytics privacy policy can be found at www.google.com.

§ 13 COPYRIGHT

  1. The proprietary rights to all training courses, provided digital content (e-books) and other educational materials contained in the Store are owned by ANYA BEAUTY and are subject to protection under the Act on Copyright and Related Rights (Journal of Laws of 2018, item 1191, as amended).

  2. The User may use the training, digital content provided and other educational materials in accordance with their intended purpose only for their personal use.

  3. The User may not make any educational materials, digital content and training provided – in whole or in part – available to third parties, in any form, without the consent of ANYA BEAUTY.

§ 14 OPINIONS

  1. ANYA BEAUTY does not provide the possibility of posting reviews about products/trainings/vouchers in the Store.

  2. ANYA BEAUTY does not guarantee that the opinions published on other portals or websites come from consumers who have used or purchased a given Product/Training/Voucher, unless the information included on the Store's website indicates that the opinion comes from a Consumer who has actually used or purchased the product.

  3. ANYA BEAUTY does not verify whether a given review/opinion found on other portals or websites comes from a Consumer who used or purchased a given Product

  4. ANYA BEAUTY does not interfere with the content of opinions posted on other portals or websites.

§ 15. REPORTING PRODUCT-RELATED INCIDENTS

  1. The Customer has the right to report an incident related to the security of the Product available in the Store, in particular if:

    1. the product poses a threat to health, life, property or the environment,

    2. an accident, injury or damage occurred in connection with the use of the product,

    3. the product has a defect that may result in unsafe behavior.

  1. Incident reports should be made immediately in one of the following ways:

    1. via e-mail: shop@anyabeauty.pl with the note "INCIDENT – PRODUCT SAFETY"

    2. by phone: +48 691 510 641

    3. via the contact form on the Store's website.

  1. The content of the report should include: the name and description of the Product affected by the incident, the date and place of the incident (if applicable), a description of the situation, including the nature of the threat or damage, and the contact details of the reporting person.

  1. ANYA BEAUTY undertakes to analyse the notification as soon as possible, taking into account the obligations arising from GPRS, including the possible transfer of information to the relevant market surveillance authorities (e.g. UOKiK).

  2. If a significant risk is identified, ANYA BEAUTY will take appropriate remedial action, including:

    1. warning users,

    2. withdrawal of a product from circulation or from the market,

    3. notification of supervisory authorities,

    4. corrective actions towards buyers.

§ 18. PRODUCT RECALL PROCEDURE

  1. If ANYA BEAUTY becomes aware that the offered or delivered Product may pose a threat to health, life, property or the environment:

    1. will immediately take action to assess the risk,

    2. will inform the market surveillance authorities, in particular the President of the Office of Competition and Consumer Protection, in accordance with applicable law,

    3. will provide users with a public warning containing the necessary information about the threat and next steps.

  2. ANYA BEAUTY may take action in the form of:

    1. voluntary withdrawal of the Product from the market,

    2. recovering the Product from consumers (recall),

    3. free replacement, repair or refund, depending on the nature of the threat and the condition of the Product.

  3. A consumer who has purchased a Product subject to a recall procedure has the right to:

    1. free return of the Product,

    2. free replacement of the Product with a hazard-free one (if available),

    3. repair the Product, if possible and safe,

    4. a full refund of the purchase price if replacement or repair is not possible.

  4. Shipping costs, if incurred by the consumer, will also be refunded, at the rate of the cheapest shipping method offered. The refund will be made using the same method used for purchase, unless the consumer consents to a different method.

  5. The Consumer shall not bear any costs related to the recovery procedure, including the costs of returning the Product, disassembly, transport or reassembly – if the Product requires it.

  6. ANYA BEAUTY will provide a clear and accessible procedure for reporting the return of a Product as part of a recall, including via:

    1. application form on the Store's website,

    2. e-mail messages with instructions for action,

    3. via text message

  7. The consumer will be notified of the recovery procedure:

    1. electronically;

    2. via text message

    3. through an announcement on the Store's website,

  8. In the event of a Product being returned under the recall procedure, the refund of the purchase price also includes the value added tax (VAT) paid by the Consumer as part of the original transaction.

  9. The refund, including VAT, will be made no later than 14 days from the date of receipt of the returned Product by ANYA BEAUTY or from the date the Consumer provides proof of sending it back – whichever occurs first.

  10. In the case of a purchase documented with a VAT invoice, the Consumer will also receive a corrective invoicesent electronically to the e-mail address provided.

§19. SECURITY GUARANTEE AND RISK MONITORING

  1. ANYA BEAUTY is committed to placing only safe Products on the market.

  2. Before releasing the Product for sale, ANYA BEAUTY verifies it in terms of:

    1. compliance with applicable technical standards,

    2. completeness of markings and instructions for use,

    3. the occurrence of potential threats to health, life, property or the environment,

    4. compliance with marking requirements (including CE, where applicable).

  1. ANYA BEAUTY monitors the safety of products already on the market, including:

    1. analyzes complaints, claims and notifications from customers,

    2. familiarizes itself with the opinions of the Office of Competition and Consumer Protection

    3. takes action if a risk is detected (e.g. informing, repairing, replacing, recalling the product).

  1. If a threat is detected, ANYA BEAUTY will take immediate remedial measures in accordance with Article 35 of the GPRS, in particular:

    1. inform consumers about the risks in a clear, effective and accessible manner,

    2. will provide a safe solution: repair, replacement, refund of the product or funds,

    3. will provide relevant information to the relevant supervisory authorities.

  1. The customer has the right to report any irregularities, doubts or incidents regarding product safety – in accordance with the procedure described in §17 of the Regulations.

  2. ANYA BEAUTY ensures that product safety activities are carried out with due diligence, based on the precautionary principle and taking into account applicable regulations, including the GPRS Regulation and national implementing acts.

§20. RECORDS STORAGE

  1. ANYA BEAUTY keeps documentation regarding the safety of the Products offered, including:

    1. results of internal risk assessments and product tests (if conducted),

    2. information on preventive and corrective actions,

    3. content of communications addressed to consumers and supervisory authorities,

    4. copies of incident reports and consumer reports,

    5. documentation regarding the product recall procedures carried out,

    6. correspondence with market supervision authorities, including the President of the Office of Competition and Consumer Protection.

  1. The documentation is kept for the period of:

    1. at least 10 years from the date of completion of the product's marketing, in accordance with Article 20(2) of the GPSR

    2. in the case of documents relating to complaints, withdrawals and claims – in accordance with the provisions of the Civil Code and the Consumer Rights Act (minimum 2 years),

    3. documentation regarding the processing of personal data – in accordance with the retention period indicated in the Privacy Policy and the provisions of the GDPR.

  1. Documentation may be stored in paper or electronic form, ensuring its integrity, confidentiality and availability for the purposes of:

    1. inspection or explanatory proceedings conducted by market surveillance authorities,

    2. implementation of information obligations towards consumers,

    3. legal protection and evidentiary purposes.

  1. Only authorized employees and associates of ANYA BEAUTY, as well as entities processing data on the basis of concluded agreements, have access to the documentation.

§21 FINAL PROVISIONS

  1. ANYA BEAUTY reserves the right to amend the Terms and Conditions. Any changes will be effective for Users within 30 days of being notified of the change in the Terms and Conditions via email.

  2. Using the Store after changes to the Terms and Conditions have been introduced will constitute their acceptance by the Customer, and by the User as well, before the deadline specified in point 1 above. A User who does not wish to use the Store after the changes come into effect may submit a declaration of non-acceptance of the new Terms and Conditions via the contact form available on the Store's website, or send it to the email address shop@anyabeauty.pl. Upon receipt of the declaration of non-acceptance of changes to the Terms and Conditions, ANYA BEAUTY will delete the User's Account and inform them of this fact.

  3. Orders placed before the date of introduction of changes to the Regulations are fulfilled on the basis of the provisions in force on the date of placing the order.

  4. In matters not regulated by the Regulations, the provisions of the Civil Code, the Consumer Rights Act, the Act on the provision of electronic services and other provisions of generally applicable law shall apply.

  5. If any provisions of the regulations are deemed to shape the rights and obligations of the Consumer in a manner contrary to good practice or grossly infringe his interests (prohibited contractual provisions), then the relevant provisions of generally applicable law will apply in place of such provisions.

  6. All communication with ANYA BEAUTY is in Polish.

  7. Order-related documentation (invoices, confirmations, and terms and conditions) is provided in Polish. Upon request, basic commercial information or order confirmation can be provided in English, with the Polish language being binding on the Parties.

§1. GENERAL PROVISIONS

These regulations (hereinafter referred to as the "Regulations") define the rules for using the Store, placing orders electronically, delivering ordered Products, paying for ordered Products, as well as the rights of the Customer and the User arising from the sales contract, in particular the rules for withdrawing from this contract and the rules for submitting and considering complaints.

§2. DEFINITIONS

  1. ANYA BEAUTY – ANYA BEAUTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Wrocław, ul. Lekcyjna 101 (postal code 51-169), KRS number 0001022210, NIP number 8952253988, REGON number 52460866400000, e-mail address: shop.anyabeauty@gmail.com

  2. Shop online shop run by ANYA BEAUTY located at the Internet address http://anyabeauty.pl through which ANYA BEAUTY provides services electronically, including an offer of Products;

  3. Customer – a natural person, legal person or organizational unit without legal personality but with legal capacity, using the Store, for whom services may be provided electronically or with whom a sales contract may be concluded;

  4. User – a registered Customer who uses the store via an Account.

  5. Consumer – a Customer who is an individual entering into a sales contract with ANYA BEAUTY for purposes not directly related to their business or professional activity. By using the Store, the Consumer consents to concluding distance contracts using means of distance communication – the Internet and email.

  6. Account – User account, created during registration in the Store, intended for use by one entity;

  7. Electronic payment – ​​a method of making a payment during which the Customer proceeds directly from the Store to select a bank, log in to it and make an electronic transfer (which includes, in particular, payment via Przelewy 24 and PayPal).

  8. Product – accessories and cosmetics sold through the store, which are sent by post or courier, e-books.

  9. Training – services provided by ANYA BEAUTY within the Store under an agreement concluded with the Client, based on conditional access, defined in the Act of 5 July 2002 on the protection of certain services provided electronically based on or consisting of conditional access (i.e. Journal of Laws of 2015, item 1341), and their purchase by the Client is a condition for obtaining access to certain audiovisual materials (digital content provided by ANYA BEAUTY),

  10. Voucher – a document (including an electronic one) confirming the holder’s entitlement to provide training or purchase a Product or Products

§4. TECHNICAL REQUIREMENTS

  1. The condition for the proper use of the Store is that the Customer has an IT system that meets the following minimum technical requirements:

    1. Access to the Internet;

    2. An up-to-date browser installed on Windows 8+, MAC OSX 10.12+ operating systems (Mozilla Firefox, Opera, Google Chrome, Microsoft Edge, Apple Safari), with cookies and Java Script enabled;

    3. Having a current, active and properly configured email account.

  1. ANYA BEAUTY is not responsible for technical problems or technical limitations occurring on the computer equipment used by the Customer and which prevent the Customer from using the Store.

§5. ACCOUNT

  1. The customer may make purchases without registration, but is required to provide their name, surname, mailing address, e-mail address and telephone number in order to complete the order.

  2. Creating an Account enables the Customer to, in particular:

    1. entering, editing or deleting data, including delivery addresses;

    2. placing orders using the entered data;

    3. obtaining a permanent discount for professionals;

    4. pay for the order upon receipt of the product at the ANYA BEAUTY headquarters

  3. The condition for creating an Account is to complete a free registration, i.e. correctly complete the form sent to ANYA BEAUTY and accept the provisions of the Regulations;

  4. The data required for registration is:

    1. Username;

    2. email address.

  5. The Account is created for an indefinite period, however, the User may delete his or her Account in the Store at any time without giving any reason and without incurring any additional fees.

  6. After registering the Account, each login is performed using the data provided in the registration form.

  1. The Account may be deleted by sending a statement in this respect via the contact form after logging in to the Account or by e-mail to shop.anyabeauty@gmail.com.

  1. Account deletion is irreversible and results in the deletion of all Account content. Upon Account deletion, the User loses complete access to the Account and order history.

  2. FORM:

– cancellation of the Account. (The form should be completed and returned electronically or in hard copy only if the User wishes to cancel the Account).

    1. if the User uses the Store in a manner inconsistent with the Regulations;

    2. in cases provided for in generally applicable legal provisions

§6. RULES OF USE OF THE STORE

  1. Customers are obligated to

    1. Use the Store in accordance with the Regulations and with respect for the rights of third parties;

    2. Not taking actions consisting in sending or posting unsolicited commercial information in the Store, or posting any content that violates the provisions of the law (prohibition of posting illegal content)

    3. Not to undertake any IT activities or any other activities aimed at obtaining information not intended for the Client, including data of other Clients,

    4. not to take actions that involve unauthorized modification of the content provided by ANYA BEAUTY within the Store or abuse of the rights granted to the Customer by ANYA BEAUTY or legal provisions in a way that is contrary to the socio-economic purpose of a given right or to the principles of social coexistence.

  2. Customers are obliged to provide true information during registration and when using the Store, as well as to update it.

  3. Customers may not, without the consent of ANYA BEAUTY, copy, change the structure, modify or make available to third parties all or part of the content of the Store, in particular the information contained therein.

  4. Declarations of intent by ANYA BEAUTY and Customers are submitted in particular electronically, via the Internet, in particular to the e-mail address provided in the registration form.

  5. ANYA BEAUTY makes every effort to keep the Store updated for a wide range of devices and operating systems, but does not guarantee its compatibility and updateability with every device and system.

  6. ANYA BEAUTY reserves the right to interrupt the operation and access to the Store for an indefinite period of time due to the need to modernize, repair and maintain the Store.

  7. ANYA BEAUTY may change the functionality and content of the Store, suspend, withdraw, or limit the availability of all or part of the Products offered in the Store. If this would significantly limit the functionality of the Store, ANYA will notify Users who have purchased Products.

  8. The Customer may consent to receiving commercial information from ANYA BEAUTY, including electronically, by selecting the appropriate option in the registration form. If such consent is granted, the Customer will receive the Store's newsletter ("Newsletter") at the email address provided during registration.

  9. The customer may unsubscribe from the Newsletter service at any time.

  10. The User's violation of any of the obligations indicated in points 1-3 above constitutes a violation of the provisions of the Regulations and may result in the deletion of the Account.

§7. SALE OF PRODUCTS, TRAINING, VOUCHERS

  1. The conclusion of the sales contract for Products/Vouchers takes place upon confirmation of acceptance of the order by ANYA BEAUTY at the Customer’s e-mail address provided during registration.

  2. The Customer who is a Consumer may withdraw from the Product sales contract under the terms specified in § 10

  3. Before placing an order, the Customer should read the description of the Product/Training/Voucher provided in the Store.

  4. The contract for the Training is concluded upon confirmation of acceptance of the order by the Store at the e-mail address provided by the Customer.

  5. The Client who is a Consumer may withdraw from the contract concerning the Training under the terms specified in § 10.

  6. Termination of the Training contract for reasons attributable to the Client, before the expiry of the period for which the Training was purchased and after its commencement by the Client, will not result in a refund of the fees paid.

§8. PRICE LIST AND PAYMENT METHODS. PROMOTIONS

  1. The current offer of the Store, together with the price list and delivery costs of the Products, is posted in the Store.

  2. ANYA BEAUTY undertakes to display the price, unit price or information about the reduced price of the product in a clear, unambiguous manner, enabling price comparison, in a place that is publicly available and clearly visible to Customers, in particular Customers who are consumers.

  3. Orders placed in the Store can be paid:

    1. before receiving the product

    2. upon receipt of the product – this option is available only to Users and the collection will take place at the ANYA BEAUTY headquarters.

  4. ANYA BEAUTY does not provide the option of paying for part of the order before receiving the product and for part upon receipt of the product.

  5. Payments for Products can be made via:

    1. traditional bank transfers (payment in advance);

    2. one of the electronic payment systems accepted by ANYA BEAUTY (i.e. Przelewy 24, PayPal)

    3. at the ANYA BEAUTY headquarters in cash or card upon personal collection of the product;

    4. cash on delivery – payment is made via InPost Spółka z ograniczoną odpowiedzialnością with its registered office in Kraków, KRS number 0000543759

  6. Orders are processed upon receipt of payment transferred to ANYA BEAUTY's bank account or upon confirmation of electronic payment through an ANYA BEAUTY-accepted electronic payment system. If the User selects the payment upon collection at ANYA BEAUTY's office, the product will be packaged and awaiting the customer at ANYA BEAUTY's office immediately after placing the order. If the "cash on delivery" payment option is selected, the order will be processed immediately after placing the order.

  7. ANYA BEAUTY is not responsible for any problems related to payment processing on the part of third parties, e.g. banks or intermediary companies.

  8. The Training order is processed immediately after receipt of payment.

  9. In the case of pre-sale of the Training, access to the Training will be provided from the date indicated in the promotional offer available on the STORE website.

  10. A customer wishing to receive an invoice is required to enter data in the order form.

  11. Invoices are sent in traditional or electronic form. To receive an electronic invoice, the customer must consent to this on the order form.

  12. Electronic invoices are sent in PDF (Portable Document Format) format to the email address provided in the order form. ANYA BEAUTY sends electronic invoices, guaranteeing the authenticity of their origin and the integrity of their content in accordance with applicable law.

  13. The date of payment is considered the date the funds are credited to ANYA BEAUTY's account. ANYA BEAUTY reserves the right to temporarily introduce promotional prices, which are announced on the Store's website. Prices in the price list and the price summary for a given order will reflect these promotions.

  14. In each case of informing about a reduction in the price of a product (goods or services), ANYA BEAUTY undertakes to display information about the lowest price of this product that was valid in the period of 30 days before the price reduction was introduced.

  15. If a given product is offered for sale for a period of less than 30 days, ANYA BEAUTY will, next to the information about the reduced price, display information about the lowest price of that product, which was valid in the period from the date of commencement of offering the product for sale until the date of introduction of the discount.

  16. In the case of goods that spoil quickly or have a short shelf life, ANYA BEAUTY will display information about the price before the discount was first applied, next to the information about the reduced price.

  17. ANYA BEAUTY may provide different reference prices when informing about a product price reduction, provided that they are clearly explained, are not misleading and do not distract the Consumer from the previous price.

  18. In the event that ANYA BEAUTY individually adjusts the price of the product for the Consumer, the Consumer will be clearly and duly informed thereof.

§9. PLACEMENT AND EXECUTION OF ORDERS.

  1. The order is placed after selecting the Product and correctly completing the order form.

  2. The Customer may place orders for Products/Trainings/Vouchers available in the Store's assortment 7 days a week and 24 hours a day, subject to trade prohibitions or restrictions resulting from the provisions of generally applicable law.

  3. After placing an order and selecting a payment method, the Customer will receive a confirmation of the sales agreement via email, along with instructions on how to proceed and the terms of the agreement. If electronic payment is selected, the Customer will be redirected to the website of the operator acting as an intermediary in the transaction.

  4. Once the payment is credited to ANYA BEAUTY's bank account, the order will be immediately forwarded for execution, provided that the User provides the details of the recipient of the shipment (including the delivery address and contact telephone number).

  5. The customer is obligated to provide a current and accurate address to which the product is to be delivered. If the customer provides an incorrect or inaccurate address, ANYA BEAUTY is not responsible for non-delivery or delay in delivery of the product.

  6. Information about the current order status and estimated delivery date is available after logging in to your Account in the Your Orders section.

  7. If payment is not received within 14 days of placing the order, ANYA BEAUTY has the right to cancel the order.

  8. ANYA BEAUTY does not fulfill orders outside of Poland.

  9. The User may cancel an order by calling +48 691 510 641 or by email at shop.anyabeauty@gmail.com. Only orders that have not yet been completed can be canceled. In the case of Products, the time of shipment to the Customer is decisive.

§10. WITHDRAWAL FROM THE CONTRACT

  1. The Consumer may withdraw from the Product/Voucher sales contract without giving any reason and without incurring any additional fees within 14 days from the date of delivery of the Products/Voucher to the address indicated by the User.

  2. The Consumer may withdraw from the Training Agreement without providing a reason and without incurring any additional fees until the Store begins providing the ordered service or digital content to the Consumer, within 14 days of concluding the agreement. The Consumer loses the right to withdraw from the Training Agreement if the provision of the service began with their express consent before the expiry of the withdrawal period and after the Store has informed the Consumer of the loss of the right to withdraw from the agreement. The Store begins providing the service upon first logging in.

  3. Withdrawal from the Product sales contract takes place by means of an unequivocal declaration by the Consumer

  4. A template for the declaration of withdrawal from the Product/Voucher sales agreement is provided as Appendix 1 to these Terms and Conditions. Consumers may use the template form, but it is not mandatory.

  5. If the Consumer submits a declaration of withdrawal from the contract via e-mail, the declaration should be sent to shop.anyabeauty@gmail.com. If the Consumer submits a declaration of withdrawal in writing, the declaration should be sent to ANYA BEAUTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Lekcyjna nr 101, 51-169 Wrocław.

  6. In order to meet the deadline for withdrawal from the contract for the sale of Products/Voucher, it is sufficient for the Consumer to send information concerning the exercise of his right to withdraw from the contract before the expiry of the deadline for withdrawal from the contract.

  7. In the event of withdrawal from the Product/Voucher sales agreement, the Customer will be refunded all payments received, including the costs of delivery. If the Consumer selects a delivery method other than the cheapest delivery method offered by ANYA BEAUTY, only the costs of returning the Products will be refunded, up to the amount corresponding to the cheapest delivery option. The refund will be made immediately, and in any case no later than 14 days from the date on which ANYA BEAUTY was informed of the decision to exercise the right of withdrawal, subject to point 9 below. The form of refund depends on the payment method chosen when placing the order.

  8. In the event of withdrawal from the Training Agreement, the Consumer will be refunded all payments received. The refund will be made immediately, and in any event no later than 14 days from the date on which the Store is informed of the decision to exercise the right of withdrawal.

  9. ANYA BEAUTY reserves the right to withhold reimbursement of payments for the Products until the Products have been received back or the Consumer has provided proof of having sent them back, whichever occurs first.

  10. The Consumer is obligated to return the Products to ANYA BEAUTY in undamaged condition immediately, but no later than 14 days from the date on which they withdrew from the Product sales contract. To meet the 14-day deadline, it is sufficient to return the Products before its expiry.

  11. Returned Products should be packed and secured in such a way that they will not be damaged during transport.

  12. The Consumer bears only the direct costs of returning the Products, i.e. the cost of sending the Products back to ANYA BEAUTY.

  13. The Consumer is liable for any diminished value of the returned Products resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the Products. ANYA BEAUTY reserves the right to pursue claims against the Consumer, including for damages, to the extent permitted by applicable law.

§ 11. ANYA BEAUTY LIABILITY. COMPLAINTS

  1. ANYA BEAUTY undertakes to deliver products without defects and is liable to the Customer if the purchased Products have a physical or legal defect (warranty).

  2. If the purchased Products have defects, the Customer may:

    1. request the replacement of the Products with new ones;

    2. demand removal of the defect,

    3. submit a declaration of price reduction,

    4. submit a declaration of withdrawal from the contract, provided that the defect is significant.

  3. The Customer is not entitled to submit a price reduction or withdrawal from the contract if ANYA BEAUTY promptly and without undue inconvenience replaces the Products with defect-free ones or removes the defect. This limitation does not apply if the Products have already been repaired or ANYA BEAUTY has failed to fulfill its obligation to replace or remove the defect.

  4. If the Customer is a Consumer, they may request a replacement of the Product with a defect-free product instead of the defect removal proposed by ANYA BEAUTY, or request the removal of the defect instead of replacement. This right does not apply if restoring the Product to conformity with the contract in the manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by ANYA BEAUTY.

  5. If the Consumer, in exercising his/her rights under the warranty for physical or legal defects of the Product, requests its replacement or repair, or withdraws from the contract, the delivery of the Product subject to the complaint to ANYA BEAUTY shall be carried out by the Consumer, but at the expense of ANYA BEAUTY, with the proviso that only the costs of returning the Product subject to the complaint shall be reimbursed up to the amount corresponding to the cheapest delivery option.

  6. The costs of returning the Product complained about by a Customer who is not a Consumer shall be borne by the Customer.

  7. Complained Products should be returned to the following address: ANYA BEAUTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Wrocław, ul. Lekcyjna 101 (postal code 51-169). For identification purposes, the Product in question should be accompanied by the order number, a description of the reason for the complaint, and an indication of the scope of actions the Customer expects ANYA BEAUTY to perform. A sample Product complaint form is attached as Appendix 2 to these Terms and Conditions.

  8. It is recommended to attach proof of purchase or a copy thereof to the Product being complained about, as this will facilitate complaint processing. However, failure to attach proof of purchase or a copy thereof will not prevent the complaint process.

  9. ANYA BEAUTY undertakes to consider the complaint within 14 days of its receipt.

  10. If the Customer’s complaint is accepted, ANYA BEAUTY bears the cost of returning the Product subject to the complaint (receipt of the complaint) and sending the Product free from defects (if this method of settling the complaint was chosen).

  11. If the complaint is rejected, the Product will be returned at the Customer's expense.

  12. In the event of withdrawal from the sales contract for Products due to defects, ANYA BEAUTY shall refund to the Customer the previously paid delivery costs in full or in part.

  13. A partial refund of delivery costs is available if the Products in question were one of several in an order placed by the Customer. In such cases, the refund of delivery costs is made proportionally to the value of the order.

  14. In the cases referred to in points 10 and 12 above, ANYA BEAUTY covers the costs only up to the amount corresponding to the cheapest delivery option offered in the Store.

  15. The refund of delivery costs to the User's bank account will be made immediately.

  16. The Store undertakes to provide Training with due diligence in accordance with the principles set out in the Regulations.

  17. Any reports regarding the possible improper implementation of the Training should be sent to the email address shop.anyabeauty@gmail.com. The Store undertakes to respond within 14 business days of receiving the report and informing the Customer.

  18. The Store is not responsible for the effect expected by the User and the purpose of using the Training, including the effectiveness of learning via the Store.

§12. PERSONAL DATA

  1. Personal data obtained by ANYA BEAUTY in the Store, including data obtained during the registration process in the Store, are protected.

  2. Deletion of personal data. Any request by the User to have ANYA BEAUTY delete the personal data provided in the registration form will result in the data being deleted.

  5. Personal data are processed:

    1. for direct marketing purposes;

    2. for analytical and statistical purposes;

    3. resulting from the legitimate interest of the Controller, i.e. for archival (evidence) purposes, securing information in the event of a legal need to prove facts or demonstrate performed obligations, in order to establish, pursue or defend against claims, and to conduct the Controller's operational activities;

    4. in order to process payments – in the case of electronic payments, ANYA BEAUTY has the right to transfer the customer’s personal data, including e-mail address, name and surname (company name), and residential address – about which the customer will be informed in accordance with Article 13 paragraph 1 letter e) of the GDPR.

    5. ANYA BEAUTY declares that it has entered into an Agreement on accepting payments using payment instruments with PAY PRO SA, KRS number 0000347935, and therefore, when making payments using payment services provided by the aforementioned company, ANYA BEAUTY transfers the Customer's personal data to PAY PRO. SA, including their email address, first and last name, and address of residence. Furthermore, PAY PRO SA, as the controller of this data, will inform the customer within the timeframe and in the manner specified in Article 14, paragraph 3 of the GDPR, that it has obtained this personal data from ANYA BEAUTY;

    6. ANYA BEAUTY declares that it has entered into an Agreement with PayPal (Europe) S.à rl et Cie, SCA ("PayPal"); and uses PayPal, in particular, to receive payments from sales. Therefore, when making payments using PayPal's payment services, ANYA BEAUTY transfers the Customer's personal data to PayPal, including email address, first and last name/company name, home address/company headquarters, and telephone number.

    7. ANYA BEAUTY declares that it has entered into a Subscription Agreement with Inpost, KRS number: 0000543759, regarding postal and transport services and related services (including cash on delivery). Therefore, when processing shipments and payments through Inpost, ANYA BEAUTY provides Inpost with the Customer's personal data, including email address, first and last name/company name, residential address/company headquarters, and telephone number.

  1. Providing data is voluntary, but necessary to achieve the above purposes.

  2. Personal data retention period. Personal data processed are retained for the period necessary to fulfill the purpose for which the data is processed (including in accordance with applicable legal requirements).

  3. Legal basis for personal data processing. Personal data is processed when:

    1. Processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject before entering into a contract (Article 6(1)(b) of the GDPR);

    2. Processing is necessary to comply with a legal obligation to which ANYA BEAUTY is subject as the Controller (Article 6, paragraph 1, letter c of the GDPR);

    3. Processing is necessary for the purposes resulting from the legitimate interest of the Controller, i.e. for archival (evidential) purposes, securing information in the event of a legal need to prove facts or demonstrate, demonstrate performed obligations, in order to establish, pursue or defend against claims, conduct the Controller's operational activities and marketing activities.

  4. Data Recipients. The recipients of your personal data are individuals authorized by the Controller to process data as part of their official duties, as well as entities commissioned by the Controller to perform activities that require data processing ("Processors"). Recipients of your personal data may also include entities authorized to access your data only in justified cases and under applicable law. Your data will not be transferred outside the European Economic Area.

  5. Due to the fact that ANYA BEAUTY uses personal data, the User has the right to:

    1. access to personal data;

    2. request the rectification, deletion and restriction of the processing of personal data;

    3. object to data processing due to specific situations – in cases where we use the data based on our legitimate interest;

    4. to transfer personal data, i.e. the right to receive your personal data from us in a structured, commonly used and machine-readable format.

  6. Furthermore, the User may transfer this personal data to another data controller or request that the Controller transfer this data to another controller. However, the Controller will only do so if such transfer is technically feasible. The right to transfer personal data only applies to data processed by us on the basis of a contract.

  7. To exercise the rights indicated in points 10 and 11 above, please contact the Administrator.

  8. Users also have the right to lodge a complaint with the supervisory authority responsible for personal data protection, i.e., the President of the Personal Data Protection Office. We assure you that we make every effort to ensure the physical, technical, and organizational protection of personal data against accidental or intentional destruction, accidental loss, alteration, unauthorized disclosure, use, or access, in accordance with all applicable regulations. If you wish to exercise this right, please contact shop.anyabeauty@gmail.com.

  9. ANYA BEAUTY does not collect personal data from children or minors. If an Account is created by a child or minor, it is only with the consent and using the data of a parent or legal guardian – in which case ANYA BEAUTY must be notified immediately.

  10. The Store also uses cookies. These files are stored on the Customer's computer by the server and provide statistical data about the Customer's activity, in order to tailor the offer to their individual needs and tastes. The Customer may disable cookies in their web browser at any time, although they should be aware that in some cases, disabling these files may impede their use of the Online Store's offerings.

  11. If the Store's website contains links to other websites not administered by the Store, the Store is not responsible for the content of those websites or the level of privacy protection implemented by their administrators. Customers who decide to visit such websites do so at their own risk. The Store also encourages customers to review the privacy policies of those websites before providing them with their personal data.

  12. The Store also collects anonymous statistical data about the pages you visit. This data is used solely for statistical analysis of traffic on the Store's websites. The Google Analytics privacy policy can be found at www.google.com.

§ 13 COPYRIGHT

  1. The proprietary rights to all training courses, provided digital content (e-books) and other educational materials contained in the Store are owned by ANYA BEAUTY and are subject to protection under the Act on Copyright and Related Rights (Journal of Laws of 2018, item 1191, as amended).

  2. The User may use the training, digital content provided and other educational materials in accordance with their intended purpose only for their personal use.

  3. The User may not make any educational materials, digital content and training provided – in whole or in part – available to third parties, in any form, without the consent of ANYA BEAUTY.

§ 14 OPINIONS

  1. ANYA BEAUTY does not provide the possibility of posting reviews about products/trainings/vouchers in the Store.

  2. ANYA BEAUTY does not guarantee that the opinions published on other portals or websites come from consumers who have used or purchased a given Product/Training/Voucher, unless the information included on the Store's website indicates that the opinion comes from a Consumer who has actually used or purchased the product.

  3. ANYA BEAUTY does not verify whether a given review/opinion found on other portals or websites comes from a Consumer who used or purchased a given Product

  4. ANYA BEAUTY does not interfere with the content of opinions posted on other portals or websites.

§15 FINAL PROVISIONS

  1. ANYA BEAUTY reserves the right to amend the Terms and Conditions. Any changes will be effective for Users within 30 days of being notified of the change in the Terms and Conditions via email.

  2. Using the Store after changes to the Regulations have been made will constitute their acceptance by the Customer, and by the User as well, before the deadline specified in point 1 above. A User who does not wish to use the Store after the changes come into effect may submit a declaration of non-acceptance of the new Regulations via the contact form available on the Store's website, or send it to the email address shop.anyabeauty@gmail.com. Upon receipt of the declaration of non-acceptance of changes to the Regulations, ANYA BEAUTY will delete the User's Account and inform them of this fact.

  3. Orders placed before the date of introduction of changes to the Regulations are fulfilled on the basis of the provisions in force on the date of placing the order.

  4. In matters not regulated by the Regulations, the provisions of the Civil Code, the Consumer Rights Act, the Act on the provision of electronic services and other provisions of generally applicable law shall apply.

  5. If any provisions of the regulations are deemed to shape the rights and obligations of the Consumer in a manner contrary to good practice or grossly infringe his interests (prohibited contractual provisions), then the relevant provisions of generally applicable law will apply in place of such provisions.
